Osborne 用”fundamental fairness / change lives for the better”包装改革,作者却连串反问(Help? Really?)

  3. 细节题回原文定位同义替换:经济类正确项常把 scale back→restriction、perform worse→do less well。

P1Over the past decade, thousands of patents have been granted for what are called business methods. Amazon.com received one for its “one-click” online payment system. Merrill Lynch got legal protection for an asset allocation strategy. One inventor patented a technique for lifting a box.

P2Now the nation’s top patent court appears completely ready to scale back on business-method patents, which have been controversial ever since they were first authorized 10 years ago. In a move that has intellectual-property lawyers abuzz, the U.S. Court of Appeals for the Federal Circuit said it would use a particular case to conduct a broad review of business-method patents. In re Bilski, as the case is known, is “a very big deal,” says Dennis D. Crouch of the University of Missouri School of Law. It “has the potential to eliminate an entire class of patents.”

P3Curbs on business-method claims would be a dramatic about-face, because it was the Federal Circuit itself that introduced such patents with its 1998 decision in the so-called State Street Bank case, approving a patent on a way of pooling mutual-fund assets. That ruling produced an explosion in business-method patent filings, initially by emerging Internet companies trying to stake out exclusive rights to specific types of online transactions. Later, more established companies raced to add such patents to their files, if only as a defensive move against rivals that might beat them to the punch. In 2005, IBM noted in a court filing that it had been issued more than 300 business-method patents, despite the fact that it questioned the legal basis for granting them. Similarly, some Wall Street investment firms armed themselves with patents for financial products, even as they took positions in court cases opposing the practice.

P4The Bilski case involves a claimed patent on a method for hedging risk in the energy market. The Federal Circuit issued an unusual order stating that the case would be heard by all 12 of the court’s judges, rather than a typical panel of three, and that one issue it wants to evaluate is whether it should “reconsider” its State Street Bank ruling.

P5The Federal Circuit’s action comes in the wake of a series of recent decisions by the Supreme Court that has narrowed the scope of protections for patent holders. Last April, for example, the justices signaled that too many patents were being upheld for “inventions” that are obvious. The judges on the Federal Circuit are “reacting to the anti-patent trend at the Supreme Court,” says Harold C. Wegner, a patent attorney and professor at George Washington University Law School.

26. Business-method patents have recently aroused concern because of C

  • A. their limited value to businesses.
  • B. their connection with asset allocation.
  • C. the possible restriction on their granting.
  • D. the controversy over their authorization.

定位Now the nation’s top patent court appears completely ready to scale back on business-method patents…(P2 第1句)

C 项 possible restriction on their granting 正是 scale back on…patents 的同义改写(granting↔授权)。

27. Which of the following is true of the Bilski case? D

  • A. Its ruling complies with the court decisions.
  • B. It involves a very big business transaction.
  • C. It has been dismissed by the Federal Circuit.
  • D. It may change the legal practices in the U.S.

定位In re Bilski… is “a very big deal,” … It “has the potential to eliminate an entire class of patents.”(P2)

D 项 may change the legal practices 是 eliminate an entire class of patents 的概括转述。

28. The word “about-face” (Line 1, Paragraph 3) most probably means C

  • A. loss of good will.
  • B. increase of hostility.
  • C. change of attitude.
  • D. enhancement of dignity.

定位Curbs… would be a dramatic about-face, because it was the Federal Circuit itself that introduced such patents…(P3 首句)

29. We learn from the last two paragraphs that business-method patents B

  • A. are immune to legal challenges.
  • B. are often unnecessarily issued.
  • C. lower the esteem for patent holders.
  • D. increase the incidence of risks.

定位…the justices signaled that too many patents were being upheld for “inventions” that are obvious.(P5)

B 项 unnecessarily issued 是 too many patents…upheld for obvious ‘inventions’ 的同义压缩。

30. Which of the following would be the subject of the text? A

  • A. A looming threat to business-method patents.
  • B. Protection for business-method patent holders.
  • C. A legal case regarding business-method patents.
  • D. A prevailing trend against business-method patents.

the U.S. Court of Appeals for the Federal Circuit said it would use a particular case to conduct a broad review of business-method patents.

Curbs on business-method claims would be a dramatic about-face, because it was the Federal Circuit itself that introduced such patents with its 1998 decision in the so-called State Street Bank case, approving a patent on a way of pooling mutual-fund assets.

patent n./v.
grant v.
scale back 缩减,收缩(=restrict)
controversial adj.
authorize v.
curb n./v.
about-face n.
hedge (risk) v.
in the wake of 紧随…
eliminate v.
uphold v.

P1Ruth Simmons joined Goldman Sachs’s board as an outside director in January 2000; a year later she became president of Brown University. For the rest of the decade she apparently managed both roles without attracting much criticism. But by the end of 2009 Ms. Simmons was under fire for having sat on Goldman’s compensation committee; how could she have let those enormous bonus payouts pass unremarked? By February the next year Ms. Simmons had left the board. The position was just taking up too much time, she said.

P2Outside directors are supposed to serve as helpful, yet less biased, advisers on a firm’s board. Having made their wealth and their reputations elsewhere, they presumably have enough independence to disagree with the chief executive’s proposals. If the sky, and the share price is falling, outside directors should be able to give advice based on having weathered their own crises.

P3The researchers from Ohio University used a database that covered more than 10,000 firms and more than 64,000 different directors between 1989 and 2004. Then they simply checked which directors stayed from one proxy statement to the next. The most likely reason for departing a board was age, so the researchers concentrated on those “surprise” disappearances by directors under the age of 70. They found that after a surprise departure, the probability that the company will subsequently have to restate earnings increased by nearly 20%. The likelihood of being named in a federal class-action lawsuit also increases, and the stock is likely to perform worse. The effect tended to be larger for larger firms. Although a correlation between them leaving and subsequent bad performance at the firm is suggestive, it does not mean that such directors are always jumping off a sinking ship. Often they “trade up,” leaving riskier, smaller firms for larger and more stable firms.

P4But the researchers believe that outside directors have an easier time of avoiding a blow to their reputations if they leave a firm before bad news break, even if a review of history shows that they were on the board at the time any wrongdoing occurred. Firms who want to keep their outside directors through tough times may have to create incentives. Otherwise outside directors will follow the example of Ms. Simmons, once again very popular on campus.

21. According to Paragraph 1, Ms. Simmons was criticized for B

  • A. gaining excessive profits.
  • B. failing to fulfill her duty.
  • C. refusing to make compromises.
  • D. leaving the board in tough times.

定位Ms. Simmons was under fire for having sat on Goldman’s compensation committee; how could she have let those enormous bonus payouts pass unremarked?(P1)

B 项 failing to fulfill her duty 是该句的概括。

22. We learn from Paragraph 2 that outside directors are supposed to be D

  • A. generous investors.
  • B. unbiased executives.
  • C. share price forecasters.
  • D. independent advisers.

定位Outside directors are supposed to serve as helpful, yet less biased, advisers… they presumably have enough independence to disagree with the chief executive’s proposals.(P2)

23. According to the researchers from Ohio University, after an outside director’s surprise departure, the firm is likely to C

  • A. become more stable.
  • B. report increased earnings.
  • C. do less well in the stock market.
  • D. perform worse in lawsuits.

定位…the stock is likely to perform worse.(P3)

C 项 do less well in the stock market 是 the stock is likely to perform worse 的同义改写。

24. It can be inferred from the last paragraph that outside directors A

  • A. may stay for the attractive offers from the firm.
  • B. have often had records of wrongdoings in the firm.
  • C. are accustomed to stress-free work in the firm.
  • D. will decline incentives from the firm.

定位Firms who want to keep their outside directors through tough times may have to create incentives.(P4 倒数第2句)

A 项 may stay for the attractive offers 是这一条件句的合理推一步。

25. The author’s attitude toward the role of outside directors is B

  • A. permissive.
  • B. positive.
  • C. scornful.
  • D. critical.

They found that after a surprise departure, the probability that the company will subsequently have to restate earnings increased by nearly 20%.

真正的谓语是 increased(概率上升),别被中间长定语吓到。

Although a correlation between them leaving and subsequent bad performance at the firm is suggestive, it does not mean that such directors are always jumping off a sinking ship.

bias / biased n./adj.
independence n.
incentive n.
weather (a crisis) v.
suggestive adj.

P1In order to “change lives for the better” and reduce “dependency,” George Osborne, Chancellor of the Exchequer, introduced the “upfront work search” scheme. Only if the jobless arrive at the jobcentre with a CV, register for online job search, and start looking for work will they be eligible for benefit—and then they should report weekly rather than fortnightly. What could be more reasonable?

P2More apparent reasonableness followed. There will now be a seven-day wait for the jobseeker’s allowance. “Those first few days should be spent looking for work, not looking to sign on,” he claimed. “We’re doing these things because we know they help people stay off benefits and help those on benefits get into work faster.” Help? Really? On first hearing, this was the socially concerned chancellor, trying to change lives for the better, complete with “reforms” to an obviously indulgent system that demands too little effort from the newly unemployed to find work, and subsidises laziness. What motivated him, we were to understand, was his zeal for “fundamental fairness”—protecting the taxpayer, controlling spending and ensuring that only the most deserving claimants received their benefits.

P3Losing a job is hurting: you don’t skip down to the jobcentre with a song in your heart, delighted at the prospect of doubling your income from the generous state. It is financially terrifying, psychologically embarrassing and you know that support is minimal and extraordinarily hard to get. You are now not wanted; you are now excluded from the work environment that offers purpose and structure in your life. Worse, the crucial income to feed yourself and your family and pay the bills has disappeared. Ask anyone newly unemployed what they want and the answer is always: a job.

P4But in Osborneland, your first instinct is to fall into dependency—permanent dependency if you can get it—supported by a state only too ready to indulge your falsehood. It is as though 20 years of ever-tougher reforms of the job search and benefit administration system never happened. The principle of British welfare is no longer that you can insure yourself against the risk of unemployment and receive unconditional payments if the disaster happens. Even the very phrase “jobseeker’s allowance” is about redefining the unemployed as a “jobseeker” who had no fundamental right to a benefit he or she has earned through making national insurance contributions. Instead, the claimant receives a time-limited “allowance,” conditional on actively seeking a job; no entitlement and no insurance, at £71.70 a week, one of the least generous in the EU.

题目与逐题解析(答案:21.A 22.C 23.D 24.A 25.A,以《答案核对清单》为准)

21. George Osborne’s scheme was intended to A

  • A. encourage jobseekers’ active engagement in job seeking.
  • B. provide the unemployed with easier access to benefits.
  • C. guarantee jobseekers’ legitimate right to benefits.
  • D. motivate the unemployed to report voluntarily.

定位…introduced the “upfront work search” scheme. Only if the jobless… register for online job search, and start looking for work will they be eligible for benefit…(P1)

22. The phrase, “to sign on” (Line 2, Para. 2) most probably means C

  • A. to check on the availability of jobs at the jobcentre.
  • B. to accept the government’s restrictions on the allowance.
  • C. to register for an allowance from the government.
  • D. to attend a governmental job-training program.

定位Those first few days should be spent looking for work, not looking to sign on.(P2)

替换句子把 looking for work 与 looking to sign on 对举——这几天该用来找工作,而不是急着去登记申领救济金。

干扰A 偷换——looking for work 才是找工作,sign on 是其对立面;B、D 均无中生有,原文既未提”接受限制”也未提”就业培训项目”。

23. What prompted the chancellor to develop his scheme? D

  • A. A desire to secure a better life for all.
  • B. An eagerness to protect the unemployed.
  • C. An urge to be generous to the claimants.
  • D. A passion to ensure fairness for taxpayers.

定位What motivated him, we were to understand, was his zeal for “fundamental fairness”—protecting the taxpayer, controlling spending…(P2 末句)

替换破折号后是对动机的拆解:zeal for fundamental fairness + protecting the taxpayer,浓缩即 D 项 passion to ensure fairness for taxpayers。

干扰A 偷换——change lives for the better 是 Osborne 挂在嘴边的口号,作者用 we were to understand 反讽,并非他真正被点出的动机;B、C 正反混淆——作者笔下这套制度是”纵容懒惰、对领取者苛刻”,而非保护、慷慨对待失业者。

24. According to Paragraph 3, being unemployed makes one feel A

  • A. uneasy.
  • B. insulted.
  • C. enraged.
  • D. guilty.

定位It is financially terrifying, psychologically embarrassing and you know that support is minimal and extraordinarily hard to get.(P3)

干扰B insulted(受辱)、C enraged(暴怒)都比原文色彩强得多;D guilty(内疚)无文本依据。

25. To which of the following would the author most probably agree? A

  • A. Unemployment benefits should not be made conditional.
  • B. The British welfare system indulges jobseekers’ laziness.
  • C. The jobseeker’s allowance has met their actual needs.
  • D. Osborne’s reforms will reduce the risk of unemployment.

定位The principle of British welfare is no longer that you can… receive unconditional payments… Instead, the claimant receives a time-limited “allowance,” conditional on actively seeking a job; no entitlement and no insurance…(P4)

Really? 嘲讽之;C 正反混淆——原文说津贴是 one of the least generous in the EU,远未满足需求;D 无中生有——作者从未说改革能降低失业风险。

Only if the jobless arrive at the jobcentre with a CV, register for online job search, and start looking for work will they be eligible for benefit.

Only if 置于句首引起部分倒装:正常语序=They will be eligible for benefit only if…。

The principle of British welfare is no longer that you can insure yourself against the risk of unemployment and receive unconditional payments if the disaster happens.

upfront adj.
eligible adj.
register v.
fortnightly adv.
claimant n.
indulgent adj.
subsidise v.
dependency n.
unconditional adj.
entitlement n.
Chancellor of the Exchequer

Really?
