P1All around the world, lawyers generate more hostility than the members of any other profession—with the possible exception of journalism. But there are few places where clients have more grounds for complaint than America.

P2During the decade before the economic crisis, spending on legal services in America grew twice as fast as inflation. The best lawyers made skyscrapers-full of money, tempting ever more students to pile into law schools. But most law graduates never get a big-firm job. Many of them instead become the kind of nuisance-lawsuit filer that makes the tort system a costly nightmare.

P3There are many reasons for this. One is the excessive costs of a legal education. There is just one path for a lawyer in most American states: a four-year undergraduate degree in some unrelated subject, then a three-year law degree at one of 200 law schools authorized by the American Bar Association and an expensive preparation for the bar exam. This leaves today’s average law-school graduate with $100,000 of debt on top of undergraduate debts. Law-school debt means that they have to work fearsomely hard.

P4Reforming the system would help both lawyers and their customers. Sensible ideas have been around for a long time, but the state-level bodies that govern the profession have been too conservative to implement them. One idea is to allow people to study law as an undergraduate degree. Another is to let students sit for the bar after only two years of law school. If the bar exam is truly a stern enough test for a would-be lawyer, those who can sit it earlier should be allowed to do so. Students who do not need the extra training could cut their debt mountain by a third.

P5The other reason why costs are so high is the restrictive guild-like ownership structure of the business. Except in the District of Columbia, non-lawyers may not own any share of a law firm. This keeps fees high and innovation slow. There is pressure for change from within the profession, but opponents of change among the regulators insist that keeping outsiders out of a law firm isolates lawyers from the pressure to make money rather than serve clients ethically.

P6In fact, allowing non-lawyers to own shares in law firms would reduce costs and improve services to customers, by encouraging law firms to use technology and to employ professional managers to focus on improving firms’ efficiency. After all, other countries, such as Australia and Britain, have started liberalizing their legal professions. America should follow.

26. A lot of students take up law as their profession due to D

  • A. the growing demand from clients.
  • B. the increasing pressure of inflation.
  • D. the attraction of financial rewards.
  • C. the prospect of working in big firms.

定位The best lawyers made skyscrapers-full of money, tempting ever more students to pile into law schools.(P2)

替换made skyscrapers-full of money = D 项 the attraction of financial rewards;tempting…students to pile in 即学生被金钱吸引入行。

27. Which of the following adds to the costs of legal education in most American states? D

  • A. Higher tuition fees for undergraduate studies.
  • B. Receiving training by professional associations.
  • C. Admissions approval from the bar association.
  • D. Pursuing a bachelor’s degree in another major.

定位a four-year undergraduate degree in some unrelated subject, then a three-year law degree…(P3)

28. Hindrance to the reform of the legal system originates from A

  • A. the rigid bodies governing the profession.
  • B. lawyers’ and clients’ strong resistance.
  • C. the stern exam for would-be lawyers.
  • D. non-professionals’ sharp criticism.

定位…the state-level bodies that govern the profession have been too conservative to implement them.(P4)

替换too conservative to implement = A 项 the rigid bodies governing the profession(管理该行业的州级机构太过保守僵化,改革推不动)。

29. The guild-like ownership structure is considered “restrictive” partly because it B

  • A. prevents lawyers from gaining due profits.
  • B. bans outsiders’ involvement in the profession.
  • C. aggravates the ethical situation in the trade.
  • D. keeps lawyers from holding law-firm shares.

定位…non-lawyers may not own any share of a law firm. This keeps fees high and innovation slow.(P5)

替换non-lawyers may not own any share = B 项 bans outsiders’ involvement(禁止非律师/外行持股参与),这正是行会式所有制”限制性”的所在。

30. In this text, the author mainly discusses B

  • A. the factors that help make a successful lawyer in America.
  • B. a problem in America’s legal profession and solutions to it.
  • C. the role of undergraduate studies in America’s legal education.
  • D. flawed ownership of America’s law firms and its causes.

There is just one path for a lawyer in most American states: a four-year undergraduate degree in some unrelated subject, then a three-year law degree at one of 200 law schools authorized by the American Bar Association and an expensive preparation for the bar exam.

There is pressure for change from within the profession, but opponents of change among the regulators insist that keeping outsiders out of a law firm isolates lawyers from the pressure to make money rather than serve clients ethically.

hostility n.
inflation n.
implement v.
conservative adj. 保守的
guild-like adj.
ownership n.
liberalize v.

P1Just how much does the Constitution protect your digital data? The Supreme Court will now consider whether police can search the contents of a mobile phone without a warrant if the phone is on or around a person during an arrest.

P2California has asked the justices to refrain from a sweeping ruling, particularly one that upsets the old assumption that authorities may search through the possessions of suspects at the time of their arrest. It is hard, the state argues, for judges to assess the implications of new and rapidly changing technologies.

P3The court would be recklessly modest if it followed California’s advice. Enough of the implications are discernable, even obvious, so that the justices can and should provide updated guidelines to police, lawyers and defendants.

P4They should start by discarding California’s lame argument that exploring the contents of a smartphone—a vast storehouse of digital information—is similar to, say, going through a suspect’s purse. The court has ruled that police don’t violate the Fourth Amendment when they go through the wallet or pocketbook of an arrestee without a warrant. But exploring one’s smartphone is more like entering his or her home. A smartphone may contain an arrestee’s reading history, financial history, medical history and comprehensive records of recent correspondence. The development of “cloud computing,” meanwhile, has made that exploration so much the easier.

P5Americans should take steps to protect their digital privacy. But keeping sensitive information on these devices is increasingly a requirement of normal life. Citizens still have a right to expect private documents to remain private and protected by the Constitution’s prohibition on unreasonable searches.

P6As so often is the case, stating that principle doesn’t ease the challenge of line-drawing. In many cases, it would not be overly burdensome for authorities to obtain a warrant to search through phone contents. They could still invalidate Fourth Amendment protections when facing severe, urgent circumstances, and they could take reasonable measures to ensure that phone data are not erased or altered while waiting for a warrant. The court, though, may want to allow room for police to cite situations where they are entitled to more freedom.

P7But the justices should not swallow California’s argument whole. New, disruptive technology sometimes demands novel applications of the Constitution’s protections. Orin Kerr, a law professor, compares the explosion and accessibility of digital information in the 21st century with the establishment of automobile use as a virtual necessity of life in the 20th: The justices had to specify novel rules for the new personal domain of the passenger car then; they must sort out how the Fourth Amendment applies to digital information now.

26. The Supreme Court will work out whether, during an arrest, it is legitimate to C

  • A. prevent suspects from deleting their phone contents.
  • B. search for suspects’ mobile phones without a warrant.
  • C. check suspects’ phone contents without being authorized.
  • D. prohibit suspects from using their mobile phones.

定位…whether police can search the contents of a mobile phone without a warrant if the phone is on or around a person during an arrest.(P1)

替换search the contents…without a warrant = C 项 check suspects’ phone contents without being authorized(无证=未经授权)。

27. The author’s attitude toward California’s argument is one of A

  • A. disapproval.
  • B. indifference.
  • C. tolerance.
  • D. cautiousness.

定位The court would be recklessly modest if it followed California’s advice…(P3);…discarding California’s lame argument…(P4)

28. The author believes that exploring one’s phone contents is comparable to D

  • A. going through one’s wallet.
  • B. handling one’s historical records.
  • C. scanning one’s correspondences.
  • D. getting into one’s residence.

定位But exploring one’s smartphone is more like entering his or her home.(P4)

替换entering his or her home = D 项 getting into one’s residence。

29. In Paragraphs 5 and 6, the author shows his concern that D

  • A. principles are hard to be clearly expressed.
  • B. the court is giving police less room for action.
  • C. phones are used to store sensitive information.
  • D. citizens’ privacy is not effectively protected.

定位Americans should take steps to protect their digital privacy…(P5);stating that principle doesn’t ease the challenge of line-drawing.(P6)

30. Orin Kerr’s comparison is quoted to indicate that D

  • A. the Constitution should be implemented flexibly.
  • B. principles of the Constitution should never be altered.
  • C. California’s argument violates principles of the Constitution.
  • D. new technology requires reinterpretation of the Constitution.

定位New, disruptive technology sometimes demands novel applications of the Constitution’s protections…(P7 论点句)

They should start by discarding California’s lame argument that exploring the contents of a smartphone—a vast storehouse of digital information—is similar to, say, going through a suspect’s purse.

修饰 argument;从句主语是动名词 exploring the contents…,插入语 a vast storehouse…

Orin Kerr…compares the explosion and accessibility of digital information in the 21st century with the establishment of automobile use as a virtual necessity of life in the 20th: The justices had to specify novel rules for the new personal domain of the passenger car then; they must sort out how the Fourth Amendment applies to digital information now.

compare A with B

constitution n. 宪法
warrant n.
arrest n./v.
assumption n.
discernable adj.
discard v.
correspondence n.
line-drawing n.
disruptive adj.

P1For the first time in history more people live in towns than in the country. In Britain this has had a curious result. While polls show Britons rate “the countryside” alongside the royal family, Shakespeare and the National Health Service (NHS) as what makes them proudest of their country, this has limited political support.

P2A century ago Octavia Hill launched the National Trust not to rescue stylish houses but to save “the beauty of natural places for everyone forever.” It was specifically to provide city dwellers with spaces for leisure where they could experience “a refreshing air.” Hill’s pressure later led to the creation of national parks and green belts. They don’t make countryside any more, and every year concrete consumes more of it. It needs constant guardianship.

P3At the next election none of the big parties seem likely to endorse this sentiment. The Conservatives’ planning reform explicitly gives rural development priority over conservation, even authorising “off-plan” building where local people might object. The concept of sustainable development has been defined as profitable. Labour likewise wants to discontinue local planning where councils oppose development. The Liberal Democrats are silent. Only Ukip, sensing its chance, has sided with those pleading for a more considered approach to using green land. Its Campaign to Protect Rural England struck terror into many local Conservative parties.

P4The sensible place to build new houses, factories and offices is where people are, in cities and towns where infrastructure is in place. The London agents Stirling Ackroyd recently identified enough sites for half a million houses in the London area alone, with no intrusion on green belt. What is true of London is even truer of the provinces.

P5The idea that “housing crisis” equals “concreted meadows” is pure lobby talk. The issue is not the need for more houses but, as always, where to put them. Under lobby pressure, George Osborne favours rural new-build against urban renovation and renewal. He favours out-of-town shopping sites against high streets. This is not a free market but a biased one. Rural towns and villages have grown and will always grow. They do so best where building sticks to their edges and respects their character. We do not ruin urban conservation areas. Why ruin rural ones?

P6Development should be planned, not let rip. After the Netherlands, Britain is Europe’s most crowded country. Half a century of town and country planning has enabled it to retain an enviable rural coherence, while still permitting low-density urban living. There is no doubt of the alternative—the corrupted landscapes of southern Portugal, Spain or Ireland. Avoiding this rather than promoting it should unite the left and right of the political spectrum.

26. Britain’s public sentiment about the countryside A

  • A. is not well reflected in politics.
  • B. is fully backed by the royal family.
  • C. didn’t start till the Shakespearean age.
  • D. has brought much benefit to the NHS.

定位…this has limited political support.(P1 末句)

替换民调显示英国人以乡村为荣,但这种情感”政治支持有限” = A 项 not well reflected in politics。

27. According to Paragraph 2, the achievements of the National Trust are now being D

  • A. largely overshadowed.
  • B. properly protected.
  • C. effectively reinforced.
  • D. gradually destroyed.

定位They don’t make countryside any more, and every year concrete consumes more of it. It needs constant guardianship.(P2 末)

28. Which of the following can be inferred from Paragraph 3? C

  • A. Labour is under attack for opposing development.
  • B. The Conservatives may abandon “off-plan” building.
  • C. Ukip may gain from its support for rural conservation.
  • D. The Liberal Democrats are losing political influence.

定位Only Ukip, sensing its chance, has sided with those pleading for a more considered approach to using green land.(P3)

29. The author holds that George Osborne’s preference A

  • A. shows his disregard for the character of rural areas.
  • B. stresses the necessity of easing the housing crisis.
  • C. highlights his firm stand against lobby pressure.
  • D. reveals a strong prejudice against urban areas.

定位This is not a free market but a biased one… We do not ruin urban conservation areas. Why ruin rural ones?(P5)

30. In the last paragraph, the author shows his appreciation of C

  • A. the size of population in Britain.
  • B. the enviable urban lifestyle in Britain.
  • C. the town-and-country planning in Britain.
  • D. the political life in today’s Britain.

定位Half a century of town and country planning has enabled it to retain an enviable rural coherence…(P6)

While polls show Britons rate “the countryside” alongside the royal family, Shakespeare and the NHS as what makes them proudest of their country, this has limited political support.

Half a century of town and country planning has enabled it to retain an enviable rural coherence, while still permitting low-density urban living.

主干是 planning has enabled it to retain…;while…

poll n.
countryside n. 乡村
guardianship n.
concrete n.
endorse v.
conservation n.
renovation n.
lobby n./v. 游说
coherence n.

① “问题—对策”结构是英一议论说明文的骨架:2014T2(法律业成本+改革)、2015T2(隐私+宪法更新)都先摆问题再给主张。

下一时段预告:PR018 进入 2018–2021 英一,篇目为 2018 Text1(自动化对中产的冲击与对策)、2019 Text3(AI 伦理与 Frankenstein)、2020 Text3(企业性别配额制之辩),科技与社科评论为主,继续强化”问题—对策”与作者立场判断。
